Zoning and Entitlements
We have represented clients in obtaining zoning approvals and entitlements for a wide range of projects, including large shopping centers, mixed used projects and residential projects. Litigation attorneys in the firm have represented parties in zoning disputes and litigation, some resulting in reported decisions. We maintain excellent relationships with planning departments and elected officials in major metropolitan areas of North Carolina and the upstate portion of South Carolina.
Condemnation and Annexation
We have extensive experience in the representation of clients in condemnation cases, annexation disputes and other disputes with governmental entities concerning real property, including property tax appeals and disputes. Our experience includes cases throughout North and South Carolina. Recent cases include condemnation actions filed by the North Carolina Department of Transportation, the City of Charlotte, and the Cabarrus County Board of Education. The underlying projects have included roads, airport expansion and school construction and have involved commercial, retail, industrial and residential properties with different highest and best uses. Our litigation attorneys often work with real estate attorneys to mitigate the harmful effects of a condemnation, such as by negotiating alternative access or design changes in projects.
Tax Incentive and Similar Agreements
The firm has represented clients in negotiating tax incentive and similar agreements for relocations, developments and improvements related to corporate office, retail, mixed use and industrial projects in North Carolina, South Carolina and other states. We maintain current, detailed information regarding incentive programs in North Carolina and South Carolina and assist clients in comparing and negotiating incentive packages and agreements.
Brownfields and Wetlands
In conjunction with our firm’s environmental practice group, we represent clients in environmental land use development issues, including brownfield agreements for properties affected by environmental problems and wetlands permits and certifications for sites containing wetlands.
